These Terms of Service ("Terms") govern your access to and use of instasitebuilder.com (the "Site") and the services provided by Instasite LLC ("Instasite," "we," "us," or "our"). By accessing the Site or using our services, you agree to these Terms. If you do not agree, please do not use the Site or our services.

Our Services

Instasite provides website redesign and lead generation services for local service businesses. This includes a free homepage redesign offer, under which we may prepare a sample redesign of your existing homepage for your review. Submitting a request does not create an obligation for you to purchase any paid service, and does not obligate us to provide any specific deliverable.

The Free Homepage Redesign Offer

The free homepage redesign is provided for evaluation purposes. Any preview we create remains our property until a paid agreement is entered into. We make no guarantee regarding timing, and we reserve the right to decline or discontinue the free redesign offer for any request at our discretion.

Eligibility

You must be at least 18 years old and authorized to act on behalf of the business you represent in order to use our services.

Your Responsibilities

You agree to provide accurate information when submitting requests and to use the Site and our services only for lawful purposes. You agree not to misuse the Site, interfere with its operation, or attempt to access areas or data you are not authorized to access.

Intellectual Property

All content on the Site, including text, graphics, logos, and software, is the property of Instasite LLC or its licensors and is protected by intellectual property laws. Any redesign previews, designs, code, and related materials we create remain our intellectual property unless and until ownership is transferred to you under a separate paid agreement.

Communications Consent

By submitting a form on the Site, you consent to be contacted by Instasite by email at the address you provide. If you separately opt in by checking the applicable boxes, you also consent to receive text messages as described in those checkboxes and in our Privacy Policy. You can opt out of emails using the unsubscribe link, and out of text messages by replying STOP. Consent to receive marketing communications is not a condition of purchasing any goods or services.

Paid Services

Any paid services, including website builds, hosting, maintenance, and lead generation programs, are governed by a separate agreement that will specify pricing, scope, payment terms, and deliverables. These Terms govern your use of the Site and the free redesign offer; they do not by themselves create a paid engagement.

Disclaimers

The Site and our free offerings are provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or secure. We make no guarantee regarding business results, lead volume, search rankings, or revenue outcomes from any service.

Limitation of Liability

To the fullest extent permitted by law, Instasite LLC and its owners, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, arising out of or related to your use of the Site or our services. Our total liability for any claim arising out of these Terms or the free offerings will not exceed one hundred U.S. dollars ($100).

Indemnification

You agree to indemnify and hold harmless Instasite LLC from any claims, damages, liabilities, and expenses arising out of your use of the Site, your violation of these Terms, or your violation of any rights of a third party.

Third-Party Links

The Site may contain links to third-party websites. We are not responsible for the content, policies, or practices of any third-party sites.

Governing Law

These Terms are governed by the laws of the State of Texas, without regard to its conflict of laws principles. Any dispute arising out of these Terms will be subject to the exclusive jurisdiction of the state and federal courts located in Texas.

Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the "Last updated" date above. Your continued use of the Site after changes are posted constitutes acceptance of the updated Terms.
